发生交通事故后有哪些义务—被人追尾了，也要留在现场！

在纽约州不幸发生交通事故后，不要忘了后续很多法律义务需要遵守！千万不要认为过错责任都在对方，就可以忽略整个事故而离开现场！纽约法律对于交通事故发生后的处理流程有详细规定，每位驾驶--不论你对于事故可不可归责--都必须遵守。以下分别整理在事故当场、以及事故之后所必须完成的重要义务。
在事故现场：你必须停留在现场！
通報警察及救護車：如果涉及人员死、伤，或撞击到野生动物，你必须通报警察。若你在有人员死、伤的情况下，还离开现场，在纽约州（以及美国多数州）将构成刑事犯罪，会面临严重刑罚。同时，你也必须通知救护车来到现场，以提供必要救护。必须注意：就算你自信自己对于事故没有任何过失，这些法律义务仍然不能免除！
交換資料：若事故只涉及财产损坏，你也有义务留下你的个人资料给对方，这些资料包括：姓名、地址、驾照、车辆註册、以及保险资料。同样的，即使你对于事故没有任何过失，也必须遵守这项义务。
在事故之后
通报保险公司。必须在30天内把事故通知给你的保险公司。在纽约Non-Fault Law规定下，不论事故归责，你自己的人身伤害都先向你自己的保险公司请求理赔。通常情况里，你的保险条款里面会与你约定在30天内完成通报义务，违反这项义务，会导致理赔遭拒绝。

It is bad luck to be hit on the road. But something should draw your attention. Do not ignore your obligations for the accident even though it happened due to the opposing party’s fault entirely. New York law requires you to do somethings once you are involved in a collision regardless of whose fault. Here are some important things you must pay attention to either at the scene or afterwards.
At the scene:
You must stop. You have to call the police if it involves fatality, personal injury or wild animal. It is a criminal violation to leave the scene of an incident that involves a fatality or personal injury even if you believe you are not at fault. You are also required to call the ambulance to rescue people harmed.
Although only property matters are caused, you must exchange information with other drivers involved, basically including your name, address, driver license number, vehicle registration, and insurance information. It is your obligation even if you believe you are not at fault.
Afterwards:
Notify your insurance company. Under New York Non Fault Law, you will be seeking the compensation from your own insurance company despite at fault or not. Usually your insurance policy requires you to report the accident within 30 days. You may lose the coverage if you fail to do so.
File MV-104 Form. Whenever any person is killed or injured, both parties, whether at fault party or non fault party, and the police must file the MV-104 collision report with the New York State Department of Motor Vehicles within 10 days of the incident.
